Residency Card

A residence card (Karta pobytu) is a document that confirms the legality of your stay in Poland. The card, along with the passport, certifies a foreigner's right to stay in the country and allows for a free crossing of the border without a visa, as well as unrestricted entry into Schengen countries for up to 90 days within a 180-day period.

The residence card is a standard biometric document of the European Union, containing all your personal information:

  • place of birth,
  • PESEL number,
  • parents' names,
  • first name and surname,
  • date of birth,
  • nationality,
  • card’s expiration date.

Types of Residence Cards and the grounds for receiving one:

1. Temporary Residence Card (Karta czasowego pobytu)

This document is issued to a foreigner that allows for a legal stay in Poland for up to 3 years. It is necessary for official residence, employment, and dealing business in the country.

The card is issued based on:

  • work
  • education (full-time student)
  • family reunification
  • doing business in Poland
  • high qualification jobs (EU Blue Card)
  • humanitarian visa (humanitarian stay in Poland)


2. Long-Term Residence Card (Karta stałego pobytu)

This is a document issued to a foreigner that allows for a legal residence in Poland for an unlimited amount of time (except the card is ought to be replaced every 10 years).

A foreigner may obtain such a permit if they have:

  • a Pole's Card (Karta Polaka)
  • Polish ancestry
  • married to a Polish citizen
  • long-term stay (more than 5 years) on refugee status, international protection, or for humanitarian reasons.

3. Citizenship (Polish passport)

Citizenship is an EU sample document that certifies the identity and citizenship of its holder. A foreigner who has resided in Poland legally and continuously for starting from one up to three years may obtain a Polish passport if they already had previously obtained a permanent residence permit (karta stałego pobytu or karta rezydenta długoterminowego EU) - Recognition as a Polish Citizen.

The Polish passport is granted by the President of Poland, who has the authority to bestow Polish citizenship to any foreigner upon application. Handing out of Polish Citizenship is the prerogative of the President and according to the constitution is not restricted by any conditions.

4. EU Long-Term Resident Card (Karta rezydenta długoterminowego EU)

A document that allows a foreigner to reside in Poland legally for an unlimited amount of time (but the plastic card should be swapped every 5 years).

A foreigner who has legally resided in Poland for more than 5 years, has had stable employment for the past 3 years, and a proof of knowledge of the Polish language at level B1 is able to obtain such a card.

EU Long-Term Resident Card

What is a EU long-term resident card?

The long-term EU residence permit (EU long-term resident card) - it's your permit for an indefinite stay in Poland with all the benefits it entails! The decision about issuance of this permit doesn't have an expiration term, which grants you stability and confidence in your status.

However, it is worth remembering that the ID card itself is only valid for 5 years, after which it is due for a replacement. The advantage is the fact that you don't have to repeat the process of applying for a permit or go through the whole procedure all over again - just exchange the card!

The long-term EU residence permit that is issued by Poland also allows you to travel to the other Shengen countries. However it is important to remember that a foreigner's stay in these countries should not exceed 90 days with a 180 days time frame in between. If you intend to stay for longer, you should go through the process of legalisation according to the laws of that country.


The basis for the issuance of the long-term EU residence permit:

A foreigner has a right to apply for a long-term EU residence permit if they comply with the following conditions:

  • Legal stay in Poland: You should continuously reside in Poland for at least five years prior to application. During that period you should not leave the country for more than six months at a time, and a collective amount of time being away should not be higher than 10 months.
  • Stable and regular income: you should have a stable and consistent income for the past 3 years prior to the application, sufficient to cover living costs for yourself and any dependent family members.
  • Medical insurance: have a health insurance in accordance with the Act of August 27th, 2004, on public health services or a confirmation that the insurer covers the costs of treatment in Poland.
  • Polish language proficiency: in order to apply for a EU residence permit you ought to have a confirmed knowledge of the Polish language no lower than level B1.

  • Doing business: you are able to start a business as a sole proprietor (działalność gospodarcza).
  • Free education: you have the right to receive an education free of charge in Polish educational institutions.
  • Viability to obtain Polish citizenship: this permit opens up the road to obtaining Polish citizenship.

 

Note:

  • If the application for a long-term EU resident permit (zezwolenie na pobyt rezydenta długoterminowego UE) was submitted during your legal stay and it did not contain formal defects or the formal defects were corrected on time, the Voivode puts a stamp in the foreigner's travel document confirming the application submission. The foreigner's stay is considered legal from the moment of application submission until the date when the decision to grant the long-term EU residence permit becomes final.

 

Pay attention:

  • The stamp in the travel document does not give you the right to travel within other Schengen countries, however, you can travel back to your country of origin. Except that to return to Poland, you must obtain a visa if you come from a country that requires one in order to cross the Polish border.

 

How to obtain an EU long-term resident card?

Obtaining the EU long-term resident card (karta rezydenta długoterminowego UE) is an important step towards legalisation of your stay in Poland. The procedure for applying takes place in the Voivodeship Office in the region where you are currently living.

The key points of obtaining the card:

  • Obtaining the documents: be sure you possess all the needed documents, that confirm your status of a legal stay in Poland
  • Applying: the application must be submitted by a foreigner no later than the last day of their legal stay (for example, on the last day of the validity of their temporary residence card or visa).
  • Awaiting the decision: after being done with the application process you need to wait for Voivode's decision. It is important to pay attention to all the deadlines so your stay continues to be regarded as legal!

Permanent Residence Permit

Permanent Residence Permit is a document that grants a foreigner the right to legally stay in Poland on an unlimited basis.

  • The decision for the permanent residence permit doesn't have a termination date, which eases you off into a sense of stability.
  • The ID card itself is valid for 10 years, after which it is due for a replacement in a card renewal procedure. What's important is that you don't have to apply for a permit and go through the whole procedure all over again.
  • Permanent residence permit also grants you the right to work in Poland without needing to apply for any additional permits.


However, please beware of the fact that the permanent residency permit does not give you the right to work in any other country besides Poland.

What is a Permanent Residence Permit?

  • Have a valid Pole’s Card and intend to stay in Poland for good.
  • Are of Polish descent and intend to settle in Poland permanently.
  • Have been granted asylum in Poland.
  • Are a victim of human trafficking and meet the conditions set out in the Act on Foreigners.
  • Up until submitting the application for permanent residency, they have resided in Poland for at least 5 years on the basis of refugee status, additional protection, or residency permit for humanitarian reasons.
  • Are a child of a Polish citizen remaining under the care of parents.
  • Are a child of a foreigner who has been granted a residence permit or EU long-term residence permit based on parental rights.
  • Have been married to a Polish citizen for at least 3 years up until applying for a permanent residence card and prior to submitting this application, have resided continuously in Poland for a minimum of 2 years on the basis of a residence permit (karta pobytu), temporarily granted due to marriage to a Polish citizen or due to obtaining refugee status, additional protection, or agreement on legal stay for humanitarian reasons.

How to Obtain a Permanent Residence Permit:

The procedure for obtaining a permanent residence permit (karta stałego pobytu) takes place in the Voivodeship Office of the voivodeship where the foreigner is currently living. The application must be submitted by the foreigner who is legally staying in Poland.

Citizens of Ukraine and other CIS countries do not take theoretical and practical exams when exchanging their national licenses for Polish ones.

However, please beware that in case the licence was not exchanged in time, there is a high risk of the insurance companies having an issue with it in case of an accident. The insurance company may use the fact that the driver’s license was not exchanged in time and may ultimately refuse to pay compensation, claiming that by law the foreigner was not allowed to operate a vehicle in Poland to begin with.
